Ashton Kutcher has filed for divorce from wife Demi Moore more than a year after the couple's high-profile split.

Divorce papers were filed Friday Los Angeles Superior Court, according to People.com, with the 34-year-old Kutcher checking the ever-popular irreconcilable differences box. According to the documents, Kutcher isn't seeking any spousal support and he is not asking the court to deny the 50-year-old Moore any spousal support.

Kutcher has hired A-list divorce attorney Laura Wasser to represent him. Wasser's previous clients include Angelina Jolie, Heidi Klum and Britney Spears.

Ashton and Demi began their May-December relationship in 2003 and married in 2005. In 2010, infidelity rumors about Ashton started to swirl, and on November 17, 2011, Demi took to Twitter to announce her plans to divorce her husband.

VIDEO SHOCKER: Brute attacks woman in elevator








Police released shocking video today of a woman being pummeled in a Bronx robbery.

A suspect followed the 57-year-old victim into an elevator of a Washington Avenue building in Claremont about 9:25 a.m. yesterday, then got out one floor before the victim's floor, cops said.

When the door opened opened, she was face to face with the brute, who began punching her, authorities said.



The assault was captured on surveillance camera.

The thief took her purse, then ran off.

Police say the suspect is in his late teens, 5-foot-11, and thin. He wore a black Polo jacket and sweatpants, as well as a black hat with a red stripe during the attack.

Pawn shops enter holiday-shopping fray




















As retailers like Tiffany & Co., Saks Inc., Best Buy Co. and Wal-Mart Stores Inc. vie for last-minute holiday sales, customers are being drawn away by a growing crop of competitors: pawn shops.

From Las Vegas and Los Angeles to Miami andOrlando, pawn shops appear to have shed their stigma and become a holiday-shopping destination.

“It’s crazy. Our stores are just packed right now,” said Lawrence Kahlden, chief executive of La Familia Pawn and Jewelry, which has two stores in Miami, one in West Palm Beach, 12 in Orlando and nine in Puerto Rico.





Overall, sales are up 40 percent from last year, he said, with smartphones, laptops, flatscreen TVs and jewelry ranking as top sellers. The Miami store at 1823 NW 79th St. is the company’s No. 1 store.

“The acceptance of pawn shops has increased due to the reality shows on TV,” Kahlden said. “It has become more acceptable to come into a pawn shop — you’re curious to see what kind of deals you can get.”

Holiday season traffic is also up at publicly traded Cash America, which has 800 stores in 23 states, including 75 in Florida and a half-dozen in South Florida.

“We have a broad spectrum of customers that come in for the holidays,” said Dennis Weese, chief operating officer of Cash America.

No longer are such outlets focused solely on lending to low-income consumers in downscale neighborhoods. Many pawn shops are expanding in more-affluent areas and increasingly are seeing white-collar and higher-income shoppers — who not only may borrow money, but also buy new or used jewelry, luxury watches, game consoles and electronics, often at deep discounts compared with regular-priced retail merchandise.

“The new customers are coming from all segments of the population. What’s central to all of them is getting a good deal,” Weese added. “The consumer is very value-oriented today regardless of socioeconomic status. They put us in the consideration set the past three or four years. The stigma associated with used merchandise has gone away.”

To better compete with mainstream retailers, Cash America has its own holiday-layaway program and stages its own annual customer-appreciation event on the first Friday of December, which Weese said “gets bigger every year.” Demand for that day serves as a good indicator of its sales for the month.

Pawn shops traditionally have been seen as a last-resort source of financing for those barely making ends meet (or worse) in the U.S. economy. Yet the recession stemming from the housing bust and the financial crisis of 2008 led many middle- and upper middle-class shoppers to visit pawn shops for the first time, mainly to seek financing. That’s how they discover there are good deals to be had there, according to pawn-shop operators. Meanwhile, shows such as History Channel’s Pawn Stars have helped lower the negative impression that consumers may have about shopping at such stores.

The National Pawnbrokers Association estimated there were about 10,000 pawn shops in January, up from about 6,400 in 2007, when the most recent U.S. Census data were available. As evidence of their broadening acceptance, many of the new pawn shops are being opened in more-upscale neighborhoods across the country, the trade group’s spokesman Emmett Murphy said.

Sentencing for scam artist rescheduled




















The sentencing for Jorge Alberto Gonzalez, the scam artist who offered false investment opportunities backed by a fake painting, was rescheduled Thursday because he was in the hospital.

Defense attorney Robert Perez said his client had been admitted to Jackson Memorial Hospital for unspecified medical problems and asked the judge for permission to visit him.

Miami-Dade Circuit Judge Beth Bloom offered to sign a recommendation for visitation rights, but said it would be subject to hospital policy. She rescheduled the sentencing for Dec. 27.





Gonzalez was convicted last month of first-degree grand theft for the intricate swindle of a divorcée in 2005. He convinced Maria Davila, a clerk with Miami’s U.S. Citizenship and Immigration Services, to put her sizeable divorce settlement in his personal bank account, promising to transfer the money to Spanish investment that would see 10 percent returns over three years. As collateral he offered a painting by Cuban modernist Amelia Peláez he said was worth half a million dollars.

When Davila became suspicious and began asking about the painting in the South Florida art community, she discovered that Peláez work was a fake and the investment was a lie.

Gonzalez has a long criminal record dating back to the mid-1990s, including convictions for cocaine dealing, armed robbery and stealing artwork.

Disgraced ex-cop Kenneth Moreno turns self in to serve year sentence








Disgraced East Village ex-cop Kenneth Moreno -- the lead officer in last year's notorious "Rape Cops" trial -- finally turned himself in this afternoon to serve a year sentence for official misconduct.

"The defendant will now begin to serve his sentence, and sentence is executed," Manhattan Supreme Court Justice Gregory Carro said in ordering the cuffs go on.

Moreno looked angry but resigned as he was led off to protective custody at Rikers. In the audience, his beautiful brunette ex -- with whom he has been embroiled in a heated custody battle -- watched with mixed satisfaction.




"It's bittersweet," Maria Cruz, a bus driver from Staten Island, told The Post. "I feel my daughter is going to be hurting for her father being away," she said of their 16-year-old daughter.

Acquitted of on-duty rape and burglary but convicted of three counts of official misconduct, Moreno had been sentenced 16 months ago, but has been allowed to remain free as first the Appellate Division and then, earlier this month, the state Court of Appeals has rejected his bids to stay free.

Moreno's jailing this afternoon followed a stunning courtroom reprimand by Manhattan Federal Court Judge Richard Sullivan, who noted the defendant's "chutzpah" in asking to remain free pending a last-ditch federal appeal.

"Mr. Moreno should go to jail like anyone else who's been convicted and whose post-conviction arguments have been denied," Manhattan Federal Court Judge Richard Sullivan said earlier in refusing to issue a stay of execution of evidence.

Moreno's appellate lawyer, Stephen Preziosi, had insisted in oral arguments this afternoon that his client's Constitutional right to due process had been violated because there had been insufficient evidence for conviction.

The trial judge, Carro, had also erred in not issuing a curative instruction to jurors after prosecutors mis-instructed jurors on the law for official misconduct, Preziosi argued.

"I have to say I don't even think this was a close call," the federal judge said in rejecting Preziosi's stay of execution request, which would have required "extraordinary circumstances."

"Frankly, I think it took a certain amount of chutzpah to even bring it."

Earlier today, Morena's former; partner, Franklin Mata, turned himself in, wordlessly, to serve his own sentence, 60 days jail.

Both Moreno and his ex-partner, Franklin Mata, had been acquitted in May, 2011 of raping a drunken young fashion executive who they'd been dispatched to help into her East 13th Street apartment.

But both were convicted of three counts each of official misconduct -- one for each time the pair were caught on surveillance video using the woman's keys to re-enter her apartment.

Mata, who prosecutors said played a more minor role of lookout, will likely serve 40 days with good behavior, said his lawyer, Edward Mandery.

Moreno, a married father of two who prosecutors accused as the actual rapist, will serve closer to eight months with good behavior.

November brings tourism boost for Broward, dip for Dade and Keys




















Miami hoteliers saw occupancy fall slightly in November compared to the previous year, though rates remained stable. A spokeswoman for the Greater Miami Convention & Visitors Bureau attributed the drop to the timing of Art Basel Miami Beach and satellite fairs, some of which started in late November last year. This year, all of the fairs began in December.

Hotels in Miami-Dade were nearly 78 percent full, a drop of less than a percentage point from the year before at nearly unchanged average rates of $152.54 a day. Per-room revenue dropped slightly to $118.70, according to numbers released Thursday by Smith Travel Research.

In Broward, occupancy increased 3 percentage points to 73.5 percent, with rates up almost 4 percent to $106.82 a day. Revenue per available room jumped 7 percent to $78.47.





The Florida Keys saw occupancy drop 1.5 percentage points to 73.1 percent, with rates up almost 5 percent to more than $193. Per-room revenue increased 3 percent to more than $141.

Miami federal jury close to verdicts involving men behind ‘bar girls’ club ring




















Like an addictive soap opera, the federal trial of a South Beach ring accused of directing a gaggle of girls to swindle tourists at Russian-style clubs zigged and zagged for more than 10 weeks.

On Wednesday afternoon, the Miami jury said it is close to delivering verdicts on four men charged with fleecing hundreds of thousands of dollars from dozens of male visitors by racking up bogus bills for champagne, vodka and caviar on their credit cards.

Jurors told U.S. District Judge Robert Scola that they had reached decisions on 39 of 40 counts. The judge directed them to keep trying on the final count, and sent them back to the jury room.





The jury, which began deliberations Thursday afternoon, heard testimony from an admitted Russian mobster who organized the Miami Beach club racket; a few “bar girls” who seduced the customers at swank hotels like the Delano and lured them back to the private bars; a former Fox TV weatherman who was taken for $43,000 over two nights; and an undercover Miami Beach police officer who posed as a dirty cop and worked as a bouncer for the clubs while recording the illicit activity.

The Philadelphia TV weatherman, John Bolaris, described the so-called B-girls in his testimony as “very cutesy, like the girls next door ... the kind of girls you’d like to marry.” He was so sloshed that a pair of the beguiling girls snookered him into buying a modernistic painting of a woman that hung on the wall at the Caviar Bar on Washington Avenue. The price tag: $2,480.

And if all that weren’t enough, the four defendants took the witness stand to fight the fraud charges, which is highly unusual during a trial.

The puppet master behind the alleged scam: Alec “Oleg” Simchuk, 46, a naturalized U.S. citizen who along with others illegally brought the bar girls from Russia and the Baltic states, where he had developed his original business model before replicating it in Miami Beach. Simchuk pleaded guilty to fraud and testified in October about his partners and associates.

In 2010, Miami Beach police and the FBI launched an undercover investigation into the “B-girl” network after Bolaris and other customers complained to their credit card companies about the outlandish bar tabs.

Last year, a total of 18 defendants were charged in the fraud conspiracy. Twelve defendants, mostly women, have since pleaded guilty. Almost all have already served short prison sentences.

Standing trial since mid-October: Stanislav Pavlenko, 41; Albert Takhalov, 31; Siavash Zargari, 48, who live in the Aventura and Sunny Isles Beach areas. Longtime Sunny Isles Beach Realtor Isaac Feldman, 51, is the fourth defendant. If convicted of wire fraud, each faces up to 20 years in prison.

A fifth defendant, Kristina Takhalov, who worked as a bartender, pleaded guilty during the trial to a few wire-fraud charges, rather than go through with the final stages of the proceeding.

A sixth defendant, Simchuk’s “silent” investment partner, Andrejs Romanovs, is a fugitive in Russia. And the seventh defendant, Mikhail Rasner, a club investor with Albert Takhalov, was not on the docket because his defense lawyer was involved in another trial at the same time.

According to the charges, Simchuk and the other defendants operated the alleged ring for a year at the Caviar Bar and the Stars Lounge, both at 643 Washington Ave.; the VIP Lounge and Tangia Club, both at 841 Washington Ave; Nowhere Bar, 653 Washington Ave.; Steel Toast, 758 Washington Ave.; and Club Moreno, 1341 Washington Ave.

Before the FBI rounded up the ring in April 2011, Simchuk had already left for Latvia (later detouring to Russia), but he eventually grew tired of life on the lam. In March of this year, he made up his mind to return to Miami, disclosing his plan to his fellow fugitive in Russia.

That stirred things up. Soon after, he said he got a “threatening” call from an indicted business associate in Miami on his cellphone.

A month later, while smoking a cigarette outside his mother-in-law’s St. Petersburg apartment, he was accosted by strangers, he testified in his thick Russian accent. “One guy pulled gun on my head and said, ’Good people from Miami don’t want you to testify. You have beautiful wife. Stay at home.’ Another guy just broke my leg, just squeeze it in one shot.”

After a year as a fugitive, Simchuk was arrested by FBI agents upon his arrival at Miami International Airport in July. He promptly pleaded guilty, agreeing to testify against his alleged partners and associates.

In Simchuk’s plea agreement, he admitted that his organization ran up phony bills for booze, wine and champagne on the credit cards of blurry-eyed male tourists.

All told, the scam cost customers between $400,000 and $1 million, according to the written agreement. The “B-girls” received 20 percent commissions, while Simchuk’s partners pocketed most of the illicit profits.

Google launches ‘scan and match’ music service






LOS ANGELES (AP) — Google is turning on a “scan and match” service for Google Music users to store copies of their songs online, offering for free what Apple charges $ 25 a year for.


The service, which launched Tuesday, cuts uploading time for those who want to save their music libraries online. It scans a user’s computer and gives them online access to the songs it finds, as long as they match the songs on its servers. Otherwise, it will upload songs to a user’s online locker.






The service is similar to Apple Inc.‘s iTunes Match, which includes online storage for 25,000 songs. Google Inc. allows storage for 20,000 songs and allows users to re-download the songs only at the same quality as they were at previously. Apple upgrades songs to iTunes quality.


Amazon runs a similar matching and uploading service called Cloud Player. It costs $ 25 a year for 250,000 songs. A free version is limited to 250 songs.


Google is still a fledgling entrant into music sales since debuting its store in November 2011, though it expects to benefit from the hundreds of millions of devices that use its Android operating system on mobile devices.


According to the NPD Group, Apple accounted for 64 percent of U.S. music sales online, followed by Amazon at 16 percent. Google has no more than 5 percent, according to NPD. Other services make up the rest.


Google had sold songs at a discount at the start, but that is less so the case now. For example, it was selling the top-ranked Bruno Mars song “Locked Out of Heaven” for $ 1.29 on Wednesday, the same as iTunes, and above the 99 cents on Amazon. But its album price was lower at $ 10.49 versus $ 10.99 at both iTunes and Amazon.
